PERSONAL INJURY OVERVIEW

If you have been injured as a result of the negligence of someone else you have the right to compensation for your pain and losses. At Lawson Glod, we have 25 years experience in assisting injured parties in obtaining full recovery for their losses.

A brief summary of the process is as follows:

EVIDENCE GATHERING
In order to successfully present your case, evidence needs to be gathered and losses documented. This includes police reports, medical records and witness statements. At Lawson Glod Mahoney we will meet with you to gather the initial information and answer your questions concerning the process and dealing with the insurance companies involved..

We have access to accident reconstruction experts, investigators, and medical personnel who will assist us in properly documenting your claim.

NEGOTIATION
Once the necessary evidence has been gathered we will evaluate your case. Based on your instruction to us we will attempt to negotiate a fair settlement with the responsible parties. Based on our experience, most cases can be settled without the necessity of starting a lawsuit (litigation).

LITIGATION
If we are unable to negotiate a reasonable settlement we will take the necessary steps to commence, prosecute, and take the case to trial. Because of our experience we find that even after a lawsuit has been commenced most cases are settled by the insurance company and only rarely do we have to take the case to trial to achieve a fair settlement.

DAMAGES
You are entitled to recover damages for:

  1. Pain and Suffering and Loss of Enjoyment of Life
    This is determined by the injury you suffered and the effect it has and will have on your life. The maximum award has been set by the Supreme Court of Canada at $273,000.00
  2. Loss of Income
    Your past and future loss of income or loss of opportunity to earn an income is recoverable. You are entitled to immediate payments from your own insurer (Section B benefits) for a portion of your loss. We will assist you in recovering these payments.
  3. Loss of Housekeeping Capacity
    If you are unable to complete your normal housekeeping chores you are entitled to compensation; even if you have not paid someone to come into your home.
  4. Cost of Care
    Your medical expenses are, in most cases, covered by your own insurer. We can assist you if you have difficulty in collecting these benefits.

    Any medical expenses not covered by your insurer can be claimed against the at-fault party. This includes an award for future expenses. We have access to physical therapists, occupational therapists, vocational rehabilitation experts and economists to obtain the necessary reports and opinions to document and collect these costs.

LEGAL COSTS
At Lawson Glod Mahoney our practice is to cover all expenses of the claim. We pay all disbursements (out-of pocket expenses) of the claim and obtain reimbursement for these expenses from the at-fault party.

Our fees are charged on a percentage basis. You pay no fee unless, and until, we collect your recovery. We do not charge for an initial consultation.
